After going to my court date a couple weeks ago, I decided I wanted to do a speedy trail sense I knew they didn't have anything on me.
So today is my trail date and I'm currently getting transported to the court house. As they shackled and guided all us inmates off the bus and into the courthouse I began to feel nervous.
They processed us in then put us in a room, once I sat down on the bench I adjusted my shirt because it looked like the buttons we're going to pop open any moment.
As I sat there I began to think what could possibly happen. I could possibly go to jail for 10 to 15 years or-
"Alexander your up now!"
The officer said as he looked at me get up and walk over to him as he handcuffed me.
He guided me to the courtroom and once I stepped foot in there all eyes were on me. I couldn't look at anyone so I walked to my seat with my head down.
"Please rise. The Federal Courthouse of California in Criminal Division, is now in session, the Honorable Judge John Matthews presiding."
Said the bailiff as he stood by the judges desk.
"Everyone but the jury may be seated. Mr. Washington, please swear in the jury."
"Please raise your right hand. Do you solemnly swear or affirm that you will truly listen to this case and render a true verdict and a fair sentence as to this defendant?"
"I do."
Judge Matthwes asked as they waited for the ok to be given so they could be seated.
"You may be seated."
"Members of the jury, your duty today will be to determine whether the defendant is guilty or not guilty based only on facts and evidence provided in this case. The prosecution has the
burden of proving the guilt of the defendant beyond a reasonable doubt. This burden remains on the prosecution through the trial. The prosecution must prove that a crime was committed and that the defendant is the person who committed the crime. However, if you are not satisfied of the defendant's guilty to that extent, then reasonable doubt exists and the defendant must be found not guilty."
Said the judge as he looked at me and slightly shook his head, making me feel even more nervous.
"Mr. Washington, what is today's case?"
Mr. Matthews asked the bailiff Mr. Washington.
"Your Honor, today's case is The State of California versus Rain Alexander."
The bailiff said in return to the judge.
"Is the prosecution ready?"
The judge asked adjusting his glasses looking towards the prosecutors.
"Yes, Your Honor."
Said the prosecuting attorneys, as they looked over at me and the lady held a tight smirk.
"Is the defense ready?"
"Yes, Your Honor."
My lawyer Ms. Carter said as she stood up gathering her paper work and made her way to the podium.
"Good morning your honor and members of the jury, my name is Rasheeda Carter and I am representing Ms. Rain Alexander in this case. I intend to prove Rain Alexander not guilty due to her not being involved or committing the crimes she had been accused of committing. Please find Ms. Alexander not guilty thank you."
She gathered her paper work and made her way back to her seat next to me.
A couple minutes went by as the prosecutors called up there witnesses and I wasn't surprised that it was the devil himself and his mother, and some people I've never seen a day my life.
Next it was the defense witnesses, but I lost hope after all the shit those idiots said about me, even though I knew none of it was true.
"Please call up your first defense witness, Ms. Carter."
The judge said as I continued to look at my fingers as if they were the most interesting thing ever.
"Mr. Owens, please make your way to the stand."
I heard foot steps but I made no effort to lift my head and see who it was, but as soon as I heard their voice it caused me to look up.
"Please sate your full name."
"Marcel Owens."
After him swearing on the Bible he sat down and looked me in my eyes as he winked at me.
"Mr. Owens what is your relationship with Ms.Alexander?"
My lawyer asked as she stood in front of him.
"Im a close friend of the family, I've been around way before she was born."
"Ok, have you ever known Ms. Alexander to indulge in horrendous activities?"
"Never. If anything she'll try and dissolve the situation before it even gets to that point. Shes a lover not a fighter."
I smile at that thought and then I shook my head knowing he was stretching the truth.
"Alright thank you. You may return back to your seat."
After more witnesses such as; my father, Devon, Tiffany, Aloni, and Cookie it was time for the closing statements.
"Both the prosecution and the defense have now rested their cases. The attorneys will now present their final arguments. Please remember, what the attorneys say is NOT evidence. However, do listen closely. They are intended to aid you in understanding the case. Prosecution, you may begin."
Mr. Matthews the judge as he put his hands together and looked at everyone.
The prosecuting attorney began talking and I listened carefully.
"Thank you, your Honor. Members of the jury, today you have heard
testimony's about Ms. Rain Alexander and her committing unpleasant actions towards Mr. Dontae Peter's and their children. I would like to remind you of some important information that you should consider in your decision. These facts include her abusing drugs and alcohol on a regular basis, and neglecting her children. Her abusing the innocent children and Mr.Peters on the daily basis and lets not forget she tried killing him, so that right there is enough to support our case, along with other evidece from our witnesses. Please find the defendant guilty of the charge of Attempted murder, children endangerment, and possession of illegal narcotics. Thank you."
I held my tears in as I listened to all the bullshit and lies as they rolled off her tongue, although some was the slight truth.
"Alright defense you may proceed with your closing argument."
The judge said as he sat there showing no emotion what so ever.
"Thank you, your Honor. Members of the jury, today you have heard
testimony about Ms. Rain Alexander being an dangerous and unfit parent, which is not true. I would like to remind you of some important information that you should consider in your decision. These facts include her having multiple restraining order against Mr.Peters, and her being obducted and held hostage for five years. Also she was abused and let's not forget his confession is on tape, and she has visable evidence showing this isn't a lie. He also killed their unborn child and his daughter Diana Peters. With all those events going on she continued to be the best mother she could be, even though their children where exposed to harmful acts and behavior on the behalf of Me.Peters. As for her being in possession of drugs it's mighty funny how they couldn't find the evidence to back up that claim. So with that being said please find our client, Rain Alexander not guilty. Thank you."
Ms. Carter said as she returned back next to me. The judge cleared his throat before speaking.
"Members of the jury, you have heard all of the testimony concerning this case. It is now up to you to determine the facts. You and you alone, are the judges of the fact. Once you decide what facts the evidence proves, you must then apply the law as I give it to you to the facts as you find them."
Mr. Matthews said as he looked at all of then before returning back to whatever he was looking at on his desk.
"All rise. We will now take a break so the jury can discuss their verdict."
Mr. Washington the bailiff said as everyone began to part into different directions.
2 long stressful hours later.....
"Have you reached a verdict? "
Mr. Matthews, the judge asked as the jury returned and had got comfortable in their seats.
"We have, your Honor."
The jury foreperson said as she stood up adjusting her skirt.
"What is the verdict?"
The judge asked as if he really cared if they threw the book at me or not.
"We the jury, in the case of The State of California versus Rain Alexander, find the defendant...."
"My heart dropped as I fell on my
knees crying."
